Terms of Service

These Terms ("Terms") govern your relationship with the websites www.simondannapfel.com and www.builtforlife.coach and all services operated by Simon Dannapfel MSc, trading as Fitness To Health SD (Business ID 2275314-2, Bulevardi 54, 00120 Helsinki, Finland — "Simon Dannapfel", "we", "us", "our"). Please read them carefully. By accessing our websites, registering for any programme, or purchasing any service, you agree to be bound by these Terms. If you do not agree, please do not use the services.

1. Our services

We offer health and performance coaching, including:

The Built for Life Reset — a free programme of habits, workouts and lessons delivered through our coaching app.

Paid coaching programmes (including Built for Life coaching) — personalised online coaching delivered via our app and scheduled calls.

In-person and other coaching as separately agreed.

The scope of each service is described where it is offered. Programme-specific terms (set out in sections 12 and 13 below, or provided at the point of purchase) apply in addition to these general Terms.

2. Eligibility

You must be at least 18 years old to purchase a paid programme. The free Reset is available from age 16 with a parent or guardian's consent and payment responsibility where relevant.

3. Not medical advice

We are a health and performance coaching service, not a medical provider. We do not provide medical advice, diagnosis or treatment. Our programmes, content, assessments and recommendations are for general health and fitness purposes only.

You are responsible for ensuring you are fit to exercise and for seeking advice from a qualified medical professional before starting, particularly if you have any injury, illness, are pregnant, or have any condition that exercise or dietary change could affect. You take part at your own risk and are responsible for learning and performing exercises safely. Exercise demonstrations are provided via video and text; if you are unsure of technique, we recommend in-person guidance.

4. Health conditions

Our services are not suitable for anyone with a current injury, an eating disorder (including anorexia, bulimia or orthorexia), or a medical condition that makes exercise or dietary change unsafe without medical supervision. If this applies to you, you are responsible for obtaining medical clearance before starting and for informing us where relevant. If you are pregnant, you are responsible for informing us.

5. Results

Our methods are grounded in science and experience, but we make no guarantee that you will achieve any specific result or goal. Outcomes depend on your consistency and individual circumstances. Meaningful change takes sustained effort over time. We will always do our best to help you succeed.

6. Intellectual property

Unless otherwise stated, all content — programmes, videos, lessons, text, assessments, images and branding across our websites and apps — is the property of Simon Dannapfel and protected by copyright. It is provided for your personal use only. You may not copy, reproduce, publish, distribute, transfer, resell or otherwise share the content, or your account access, with others. Sections of the websites may be downloaded or printed for personal use only.

7. Acceptable use

Our services are for your private, personal use. You may not use them unlawfully, or in any way that causes harm or nuisance to us or others. Training alongside a friend is fine; sharing your paid account or content is not. You are welcome to mention your work with us on social media.

8. Your account and security

You are responsible for providing true information about yourself and for keeping your login details secure. We are not responsible for loss caused by your login details falling into the wrong hands, and you may be responsible for loss we suffer if an unauthorised person uses your details. If your contact details change, please notify us.

9. Limitation of liability

To the fullest extent permitted by law, Simon Dannapfel shall not be liable for any direct, indirect, incidental, special or consequential loss or damage arising from your access to or use of, or inability to use, our services, including any injury, health incident or accident, whether based on contract, tort (including negligence) or otherwise. The services are provided on an "as is" and "as available" basis. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including your mandatory statutory rights as a consumer. You acknowledge the inherent risks of physical training and are responsible for maintaining appropriate insurance.

10. Termination

We may suspend or terminate access to our services for breach of these Terms, without prior notice. Provisions on intellectual property, liability, data and governing law survive termination. Upon termination your right to use the services ceases.

11. Changes

We may modify these Terms at any time. If a change is material, we will make reasonable efforts to provide at least 30 days' notice. Continued use after changes take effect constitutes acceptance. We may also update the content of our websites and apps at any time.

12. Built for Life Reset — programme terms

These terms apply to the free Reset, in addition to the general Terms above.

Free: the Reset is free, with no payment and no obligation.

Included: a 30-day programme of daily habits, workouts and lessons via our coaching app, plus the option to book a free strategy call.

Not included: the Reset is not individually tailored and does not include one-to-one coaching, personalised programming or personalised dietary advice. Those are part of our paid coaching.

Leaving: you may stop at any time, at no cost and with no notice.

13. Paid coaching — programme terms

These terms apply to paid coaching programmes (including Built for Life coaching), in addition to the general Terms above.

13.1 What you're buying. Personalised coaching delivered online via our coaching app and scheduled calls, for the term and at the price shown at the point of purchase. What's included (programme, check-ins, group call, any one-to-one calls) is as described on your chosen plan.

13.2 Price and payment. The price and payment schedule (monthly, or paid in full) are as shown at the point of purchase. Every plan has an initial commitment period as shown (e.g. 3 months or 6 months), after which it continues on a monthly recurring basis until cancelled. Prices are in the currency shown and include Finnish VAT. Payment is taken on the schedule shown until you cancel. If a payment is not received by its due date, we may send a reminder; continued non-payment may result in suspension of access or referral of the outstanding amount for collection.

13.3 Initial commitment period and cancellation. Each plan runs for its initial commitment period, as shown at purchase. Once that period is complete, your plan continues month to month, and you may cancel at any time by giving one month's notice before your next billing date, by contacting [email protected]. You retain access until the end of the notice period.

13.4 Refunds. If you decide the programme isn't right for you, contact us at [email protected]. Fees already paid are generally non-refundable, as your programme and our coaching time are planned around your commitment, but we will always deal with genuine or exceptional circumstances fairly and on a case-by-case basis. This does not affect any statutory rights you have as a consumer that cannot be excluded by law.

13.5 What we ask of you. Coaching works as a partnership. To get results, you need to engage with the programme, complete your check-ins and practices, and keep in regular communication with us at the agreed frequency. You are responsible for informing us of any injury, illness or change in health (e.g. pregnancy, medical treatment) that could affect your coaching. We commit to delivering the coaching described; we cannot guarantee specific outcomes.

Privacy Policy

2. When we collect data

We collect personal data when you register for the Reset, book a strategy call, purchase a paid programme, use our coaching app, or otherwise contact us.

3. What we collect

Standard personal data: name, date of birth, gender, contact details, payment information, customer number, IP address and usage data, and emergency contact details where provided.

Health and special-category data (GDPR Article 9): current and past health conditions, injuries and illnesses, medical history and medications, physical fitness assessment data (body composition, strength, cardiovascular fitness, mobility), nutrition and dietary information, sleep and recovery data, lifestyle information relevant to coaching, blood test / DNA / biometric data where you share it, and photographs or videos where relevant to coaching progress. This is collected solely to deliver personalised coaching, and is processed on the basis of your explicit consent, given when you enter a coaching agreement or complete a health assessment. You may withdraw consent at any time, though this may affect our ability to continue coaching you.

Cookies: we use cookies and similar technologies to track activity on our websites. You can set your browser to refuse cookies, though some features may then not work.

4. Why we process it

To deliver personalised coaching; to fulfil obligations such as invoicing; to provide customer service; to meet legal and safety requirements; and to develop our coaching methods.

5. Legal bases

Contract performance (Art. 6(1)(b)) — standard data needed to deliver the agreement.

Explicit consent (Art. 9(2)(a)) — health data, on the basis of your explicit consent. Withdrawal does not affect prior lawful processing.

Legal obligation (Art. 6(1)(c)) — e.g. accounting records.

Legitimate interests (Art. 6(1)(f)) — where not overridden by your rights.

6. How long we keep it

Health and coaching data: 3 years after the coaching relationship ends, then securely deleted.

Financial and accounting records: 7 years (Finnish Accounting Act).

Marketing data: until you withdraw consent or request deletion.

Longer only where required to comply with a legal obligation or to establish, exercise or defend a legal claim.

7. Who we share it with

We use the following processors, who may process your data on our behalf:

Google Workspace (Google Ireland Limited) — file storage, email and business operations; data stored on EU servers under Google's Data Processing Amendment and Standard Contractual Clauses.

Payment providers (e.g. Stripe) — to handle billing.

Our coaching platform and client app — to deliver coaching programmes.

These parties may only use your data for the purposes described here and may not disclose it to others without your consent. We may disclose data where required by law or to protect our legal interests or prevent fraud. Where data is transferred outside the EU/EEA, we ensure appropriate safeguards (such as Standard Contractual Clauses). Data is stored electronically, with access restricted to those who need it.

8. Your rights

You have the right of access, rectification, erasure, restriction, data portability, objection, and withdrawal of consent, under GDPR Articles 12–22. To exercise any of these, email [email protected]; we respond within 30 days. You may lodge a complaint with the Finnish Data Protection Ombudsman (tietosuoja.fi) or your local supervisory authority. We do not use automated decision-making or profiling that produces legal or similarly significant effects.

9. Security

We take appropriate technical and organisational measures — access controls, encrypted storage via Google Workspace, and restricted access to client files — to protect your data from unauthorised access, alteration, disclosure or deletion. In the event of a breach likely to risk your rights and freedoms, we notify the Finnish Data Protection Ombudsman within 72 hours of becoming aware of it, and inform affected individuals without undue delay where required.

10. Marketing and media

With your consent, we may send you marketing information, and you may be photographed or filmed during activities; we may use such images or videos for marketing on our websites and social media, unless you tell us otherwise in writing. You may withdraw this consent at any time. This is separate from, and does not affect, your health-data consent.

11. Changes of ownership

In the event of a change of ownership of the business (such as a merger or acquisition), your personal data may be transferred in accordance with applicable law and this policy.

12. Changes to this policy

We may update this Privacy Policy and will notify you of material changes with reasonable notice. Continued use of our services after changes take effect constitutes acceptance.

Governing law

These Terms and any coaching agreement are governed by, and interpreted in accordance with, the laws of Finland, and any dispute shall be subject to the jurisdiction of the Finnish courts. This does not deprive you of the mandatory consumer-protection rights available to you under the law of your country of residence, which apply regardless of this choice of law. If any provision is held invalid or unenforceable, the remaining provisions remain in effect.
